Wyoming County Criminal Records Access

Criminal court records in Wyoming County are public unless they have been sealed. New York's Judiciary Law Section 255 says the court clerk must let people view and copy records. You do not need a specific reason. Anyone can ask to see an open file.

Records get sealed in certain situations. Under CPL 160.50, when a case ends in dismissal or acquittal, the file is sealed. The public can no longer view it. CPL 160.55 seals records where a crime charge leads to a conviction for only a violation or traffic infraction. These sealed files protect people whose cases did not result in a criminal conviction.

Some convictions can be sealed too. CPL 160.58 covers drug crimes. If a person completes a court-ordered treatment program, the judge may seal that conviction. CPL 160.59 provides a way to seal up to two old convictions, with no more than one felony, after a ten-year wait from the end of the sentence. The judge weighs the person's conduct, the nature of the crime, and the interests of justice.

Open records are available from the Wyoming County Clerk. You can visit in person or write to the office. Fees apply for copies. Certified copies with the clerk's seal cost more than plain copies. Call ahead to confirm current fees.
