Accessing Warren County Criminal Court Records

Criminal court records in Warren County are public under New York law. Judiciary Law Section 255 gives the public the right to see and copy records held by the court clerk. You do not need to give a reason for your request. Anyone can ask.

The law does seal some records. Under CPL 160.50, cases that end in dismissal or acquittal are sealed. The public cannot view these. Only the person who was charged can get a copy. CPL 160.55 covers cases where a criminal charge leads to a conviction for just a violation or traffic infraction. Those get sealed too.

New York allows sealing of certain convictions as well. CPL 160.58 covers drug offense convictions. If a person finishes a court-ordered treatment program, the judge can seal that conviction. Under CPL 160.59, a person may ask to seal up to two convictions, with at most one felony. The person must wait ten years after the sentence is done. The court weighs factors like public safety and the person's conduct since the conviction.

To get copies of open records, contact the Warren County Clerk. You can visit in person or submit a written request. There are fees for plain copies and higher fees for certified copies. The clerk's office can tell you current rates.
