Niagara County Criminal Court System

Record Sealing in Niagara County

New York uses record sealing, not expungement. CPL 160.50 requires automatic sealing when a case ends in the defendant's favor. Dismissals, acquittals, and completed adjournments in contemplation of dismissal all get sealed. Once sealed, the records are not available to the public.

CPL 160.55 covers non-criminal findings like violations. CPL 160.58 allows sealing of certain drug convictions after the defendant finishes a treatment program. CPL 160.59 lets people petition to seal up to two older convictions, but only one can be a felony. The Niagara County DA reviews all sealing petitions. A judge makes the final call.

Judiciary Law 255 gives courts general authority over their records and proceedings. If you need to seal a Niagara County criminal record, file a motion with the court. Legal aid groups in the Eighth Judicial District may help with the process if you meet income requirements.
