Sealing Criminal Court Records in Greene County

New York's record sealing laws cover Greene County the same as every other county. CPL 160.50 seals records automatically when a case is dismissed, ends in acquittal, or is adjourned in contemplation of dismissal. No filing is needed from the defendant.

CPL 160.55 covers violations and traffic infractions. After ten years without new criminal activity, a person can ask the court to seal these records. CPL 160.58 allows sealing of up to two convictions. Only one can be a felony. The wait is ten years from sentencing or release. Sex offenses, violent felonies, and Class A felonies are excluded from both of these provisions.

The Clean Slate law under CPL 160.59 provides automatic sealing for certain convictions. Misdemeanors seal after three years. Felonies seal after eight. The clock starts when the full sentence is done, including parole and probation. Serious violent felonies and sex crimes are not included. Under Judiciary Law 255, court records are not subject to FOIL. Sealed records are not available to the general public.
