Record Sealing Under New York Criminal Procedure Law
Several provisions of the Criminal Procedure Law govern when criminal records in Columbia County may be sealed from public access. These statutes apply across the entire state.
CPL 160.50 provides for automatic sealing when a criminal case ends in the defendant's favor. Dismissals, acquittals, and cases adjourned in contemplation of dismissal are all covered. Once sealed, the records cannot be found through public searches, and the person can legally deny the existence of the case in most circumstances.
CPL 160.58 allows eligible people to apply for sealing of up to two convictions. Only one can be a felony. The ten-year waiting period runs from sentencing or release, whichever comes later. The Columbia County District Attorney receives notice and may oppose the application. Violent felonies, sex offenses, and Class A felonies cannot be sealed.
