Record Sealing Laws for White Plains Criminal Cases

New York's sealing laws determine which criminal court records are available to the public. If a White Plains case has been sealed, it will not appear in any public search tool.

Under CPL 160.50, records are automatically sealed when a case ends in the defendant's favor. Dismissals, acquittals, and completed adjournments in contemplation of dismissal all trigger automatic sealing. No application is needed.

CPL 160.55 lets a person apply to seal certain violation convictions after ten years with no new criminal activity. CPL 160.58 covers up to two eligible convictions, only one of which can be a felony. Violent felonies and sex offenses are excluded. Both require a formal application to the court, and the District Attorney gets notice.

The Clean Slate Act, CPL 160.59, started in 2024. Eligible misdemeanors are sealed after three years. Eligible felonies are sealed after eight years. The sealing is automatic. Class A felonies, violent felonies, and sex offenses are not eligible. Over time, many older White Plains cases will be removed from public access under this law.

The statewide CHRS search is $95 per name. Aliases and different dates of birth each cost $95 more. Pay with a credit card online or send a check or money order by mail.

A Certificate of Disposition costs between $10 and $25. This is the official certified document that shows how a case ended. Many courts and agencies require it. You must get it from the court where the case was heard. For misdemeanors, that is White Plains City Court. For felonies, the Westchester County Clerk issues it.
