Criminal Record Sealing Laws

New York's sealing statutes control what criminal records are visible when searching Greenburgh cases.

CPL 160.50 automatically seals records when charges are dismissed or the defendant is acquitted. CPL 160.55 covers sealing of certain violation convictions after ten years without new arrests. CPL 160.58 allows sealing of up to two convictions for eligible people who have waited ten years from sentencing or release.

CPL 160.59, the Clean Slate law effective in 2024, automatically seals eligible misdemeanors after three years and felonies after eight years. Violent felonies, sex offenses, and Class A felonies are not included. This law will gradually seal many old Westchester County criminal records, including cases from Greenburgh Town Court.

Court records in New York are governed by Judiciary Law 255, not by FOIL. Requests for court records go directly to the court clerk. Police records from the Greenburgh Police Department are a separate matter and require a FOIL request to the department.
