Accessing Criminal Court Records in Wayne County

Criminal court records in Wayne County are open to the public under New York law. Judiciary Law Section 255 says the clerk of the court must let people view and copy court records. You do not need to be part of the case. Anyone may request access.

Sealed records are the exception. Under CPL 160.50, cases that end in dismissal or acquittal are sealed from public view. The person charged can still get their own copy. CPL 160.55 covers cases where a crime charge gets reduced to a violation or traffic infraction at conviction. Those records are sealed as well.

New York law also allows sealing of some convictions. CPL 160.58 lets a judge seal drug offense convictions after the person finishes a court-ordered treatment program. Under CPL 160.59, a person can ask to seal up to two old convictions if at most one is a felony. They have to wait ten years after the sentence ends. The court considers the nature of the crime, the person's record since the conviction, and the public interest.
