Record Sealing in Nassau County

New York provides record sealing, not expungement. CPL 160.50 requires automatic sealing when a case ends favorably. Dismissals, acquittals, and completed adjournments in contemplation of dismissal all get sealed. The records are then hidden from public searches and databases.

CPL 160.55 covers cases that end in a non-criminal finding. CPL 160.58 lets courts seal certain drug convictions when the defendant completes a court-ordered treatment program. CPL 160.59 allows people to petition for sealing up to two older convictions, with no more than one felony. The Nassau County DA reviews every sealing petition, and a judge decides.

Judiciary Law 255 gives courts authority over their records. Nassau County handles a large volume of criminal cases each year. If you want to seal a record, file a motion in the court that handled your case. Legal services on Long Island can help if you qualify.
