Record Sealing in Jefferson County

New York has specific rules about when criminal records get sealed. CPL 160.50 requires automatic sealing of cases that end in a favorable outcome for the defendant. This includes dismissals, acquittals, and adjournments in contemplation of dismissal after the case is fully resolved. Once sealed, the records are not available to the public.

CPL 160.55 covers certain non-criminal dispositions. If a case results in a violation or infraction rather than a crime, the record may be sealed. CPL 160.58 allows sealing of certain drug convictions when the defendant completes a treatment program. CPL 160.59 provides broader sealing for people with older convictions who meet specific criteria. Under this section, a person can ask the court to seal up to two convictions, with no more than one felony.

If you believe your Jefferson County criminal record should be sealed, you can file a motion with the court. The District Attorney will have a chance to respond. A judge then decides whether sealing is appropriate. Legal aid groups in the Watertown area can help with this process. Judiciary Law 255 also gives courts broad power to manage their own records and proceedings.
