Fees for Criminal Court Records in Fulton County

Sealing Criminal Court Records in Fulton County

New York's record sealing laws apply in Fulton County the same as they do everywhere else. CPL 160.50 seals records automatically when a case ends in the defendant's favor. This covers dismissals, acquittals, and cases adjourned in contemplation of dismissal. No action is needed from the person. The record just goes away from public searches.

CPL 160.55 allows sealing of violation and traffic infraction convictions after ten years with no new criminal history. You have to file a request with the court. CPL 160.58 goes further. It lets people seal up to two convictions, but only one can be a felony. You wait ten years from the date of sentencing or release. Sex offenses, violent felonies, and Class A felonies are excluded.

Under CPL 160.59, the Clean Slate law, certain convictions seal on their own. Three years for misdemeanors. Eight years for felonies. The wait starts when the sentence is fully done. That includes parole and probation time. Serious violent felonies and sex offenses do not qualify for automatic sealing.

Judiciary Law 255 controls access to court records in New York. These records are not subject to FOIL. All requests go through the clerk of the court. Sealed records cannot be given to the public under any of these laws.
