Criminal Record Sealing in Utica

New York law allows certain criminal records to be sealed. If a Utica case was sealed, it will not appear in a public search. Here is how the main sealing laws work.

CPL 160.50 provides automatic sealing when a case ends with a dismissal or acquittal. The person does not need to apply. It just happens. Once a case is sealed under this section, the record is hidden from public view. Only law enforcement and a handful of licensing agencies can access it.

CPL 160.55 covers violation-level convictions. After ten years without a new arrest, a person can ask the court to seal these records. CPL 160.58 allows sealing of up to two convictions, with no more than one felony. Sex offenses, violent felonies, and Class A felonies are not eligible. The ten-year clock starts from sentencing or release, whichever comes last.

The Clean Slate Act, CPL 160.59, began in 2024. It automatically seals eligible misdemeanor convictions after three years and eligible felonies after eight years. The person does not need to apply. This law does not cover Class A felonies, violent felonies, or sex offenses. Many older Utica criminal records will be sealed under this law over the coming years.
