Criminal Record Sealing for Union Cases

New York's record sealing statutes apply to all courts in the state, including the Union Town Court. Sealed records are not available through public searches.

CPL 160.50 automatically seals records when a case ends in the defendant's favor. This covers dismissals, acquittals, and completed adjournments in contemplation of dismissal. No action by the defendant is needed. CPL 160.55 allows sealing of certain violation convictions after ten years without a new arrest. The person must file an application with the court.

CPL 160.58 permits sealing of up to two convictions. Only one can be a felony. Violent felonies, sex offenses, and Class A felonies are excluded. The waiting period is ten years from sentencing or release from incarceration.

The Clean Slate Act under CPL 160.59 started in 2024. It seals eligible misdemeanors after three years and eligible felonies after eight years. The process is automatic. Serious offenses are excluded. Over time, many older Union town court convictions will be sealed under this law.
